Terms of Service

1. Agreement to these terms

By signing up for dietfam, you agree to these Terms of Service. If you do not agree, do not use the service. These Terms form a legally binding contract between you and dietfam Ltd, a company registered in England and Wales. We may update these Terms and will notify you at least 30 days before any material change takes effect.

2. Eligibility

You must be:

  • At least 18 years old
  • Legally capable of entering a binding contract
  • Not previously banned from the service

You confirm these at onboarding. If we learn you do not meet these conditions, we will terminate your account and refund any unused subscription period.

3. What dietfam is — and what it isn't

dietfam is a behavioural-coaching companion that helps you log what you eat and how you move via WhatsApp voice notes. The coach is an AI system (Anthropic Claude with Google Gemini for transcription).

dietfam is NOT:

  • A medical device, medical advice, or medical treatment
  • A diagnosis tool for any condition (including eating disorders)
  • A substitute for a doctor, dietitian, therapist, or qualified clinician
  • A replacement for emergency services
  • Suitable for use during a medical emergency

Calorie and macro estimates are estimates with a typical accuracy band of approximately ±15%. They are not suitable for clinical use (e.g. carbohydrate counting for type 1 diabetes management).

If you are pregnant, breastfeeding, recovering from surgery, have a diagnosed eating disorder, or take medication that affects appetite or metabolism, please consult your doctor or registered dietitian before relying on dietfam's estimates.

4. Safety screening at onboarding

dietfam includes a brief screening questionnaire at onboarding (the SCOFF screen). Users scoring in the higher-risk range for eating-disorder indicators will not be onboarded, and will instead be referred to specialist resources. This is a safety choice; it is not a clinical diagnosis.

If you screen out, we do not retain your responses beyond the safety audit log; you may re-attempt the screening after 90 days.

5. Your responsibilities

You agree to:

  • Provide honest information at onboarding and in your daily voice notes
  • Use the service for its intended purpose (personal macro and activity tracking)
  • Not use the service to receive medical, clinical, or therapeutic care
  • Not share your account access
  • Comply with WhatsApp's own Terms of Service
  • Respect your dyad partner's data and consent

You may not:

  • Use dietfam to harass, surveil, or coerce another person
  • Attempt to extract another user's data through your dyad partnership or by any other means
  • Reverse-engineer, scrape, or systematically harvest content from the service
  • Misuse the safety/crisis routing (e.g. fabricating crises to test the system)

We reserve the right to suspend or terminate accounts that violate these responsibilities.

6. Subscription, billing, trial

Free trial

  • 14 days free of charge
  • A valid payment method is required up-front to start the trial (Stripe Checkout collects card or supported equivalent)
  • You are not charged during the 14-day trial period
  • Your first charge is on day 15 unless you cancel before then; cancellation is one click in the dashboard or one message in WhatsApp

Pricing

  • Monthly: $8.00 USD
  • Annual: $69 USD (saves ~28%)

All prices in USD; applicable VAT/sales tax may be added at checkout. Prices may be updated; existing subscribers are notified at least 30 days before any price increase.

Friend-pair invite

When you invite a friend, both of you receive one month free after they accept. There is no permanent pair discount.

Cancellation and refunds

  • Cancel any time via /cancel in WhatsApp or via the dashboard
  • Cancellation takes effect at the end of your current billing period
  • We do not pro-rate refunds for partially-used months
  • If you cancel within 14 days of your first paid charge AND have used the service less than 5 times, contact us via the dashboard for a full refund

Failed payments

If a payment fails, we retry over 3 days and message you. If the retry chain fails, your account moves to read-only access until you update your payment method.

7. Intellectual property

  • Your data is yours. You retain all rights to voice notes, transcripts, food logs. You grant us a non-exclusive licence to process this data to deliver the service.
  • dietfam's content is ours. The dietfam name, brand, code, prompts, and product design are our intellectual property. You may not use them outside the service.
  • Aggregate insights: we may produce de-identified aggregate insights for internal use. These contain no personally identifiable information.

8. Service availability

We aim for 99.5% monthly uptime but do not guarantee it — the service depends on third parties (WhatsApp, AWS, Anthropic, Google) that have their own availability profiles. We will not be liable for service interruptions caused by these third parties.

For planned maintenance, we will notify you at least 24 hours in advance via WhatsApp. The dashboard status page shows current state.

9. AI disclaimers

The coach is an AI system. AI systems can:

  • Misestimate calories, portions, or macros
  • Misidentify foods, especially regional or home-cooked dishes
  • Occasionally produce a reply that misses important context
  • Fail to detect a safety signal that a human would catch (or fire one that a human wouldn't)

Our Safety page describes the safeguards we operate, including weekly AI-led safety reviews. If you observe AI behaviour that concerns you, use the contact form on dietfam.app or the dashboard. We acknowledge incident reports within 24 hours.

10. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, or punitive damages
  • Our total aggregate liability for any claim is capped at the amount you paid us in the 12 months before the claim
  • We make no warranties beyond those required by law

Nothing in these Terms limits or excludes:

  • Liability for death or personal injury caused by our negligence
  • Liability for fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited or excluded under the UK Consumer Rights Act 2015 or equivalent applicable consumer-protection law

UK and EU consumers retain all statutory rights.

11. Indemnification

You agree to indemnify and hold dietfam harmless from any third-party claims arising from your misuse of the service, your violation of these Terms, or your violation of any law in your use of the service. This indemnification does not apply where the claim arises from our breach of these Terms, our negligence, or our failure to deliver the service as described.

12. Termination

We may suspend or terminate your account if you violate these Terms, your account shows abuse or harassment of another user, we are required to by law, or we discontinue the service (we will give 90 days' notice and pro-rata refund any unused subscription).

You may terminate at any time via /delete (full deletion within 30 days) or /stop (suspension without deletion).

13. Governing law and disputes

These Terms are governed by the laws of England and Wales.

UK and EU users

Disputes will be resolved in the courts of England and Wales. UK and EU consumers retain the right to bring proceedings in their country of habitual residence.

US users — arbitration

By signing up from the United States, you agree that any dispute arising from these Terms or your use of the service will be resolved by binding individual arbitration administered by JAMS under its Consumer Arbitration Rules, in your county of residence or remotely at your election. You waive any right to participate in a class action against dietfam.

This arbitration clause does not apply to small-claims-court proceedings, to injunctive relief for our intellectual property, or to the extent it is unenforceable under your state's law.

Indian users

Disputes will be subject to the jurisdiction of the courts of Mumbai, India.

14. Severability

If any part of these Terms is found unenforceable, the remainder remains in effect.
